TIER ONE ACADEMY

ASSUMPTION OF RISK, WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT

1. ACKNOWLEDGMENT OF RISKS

Participation in martial arts training, including but not limited to striking, grappling, self-defense drills, sparring, weapons training, physical conditioning, and use of fitness equipment, involves inherent and unavoidable risks. These risks include, but are not limited to:

• Bruises, sprains, strains, fractures, cuts, and abrasions

• Head, neck, and spinal injuries

• Joint dislocation or ligament tears

• Serious bodily injury, paralysis, or death

• Emotional stress or psychological discomfort

• Exposure to communicable illnesses and infectious diseases

All such risks—known or unknown—are voluntarily assumed, even if arising from the negligence of Tier One Academy or its representatives.

2. RELEASE OF LIABILITY

In consideration for being allowed to participate in any activity, program, or training at Tier One Academy, the participant hereby RELEASES, WAIVES, AND DISCHARGES:

Tier One Academy, its owners, officers, instructors, employees, contractors, and representatives

from any and all liability, claims, demands, or causes of action related to:

• Personal injury

• Property damage

• Illness or death

• Any loss or harm resulting from participation

This release applies to the fullest extent permitted by law, including claims based on ordinary negligence.

3. INDEMNIFICATION

The participant agrees to defend, indemnify, and hold harmless Tier One Academy from all claims, damages, costs, and attorney fees arising out of their participation in academy activities, including claims brought by third parties.

4. MEDICAL TREATMENT CONSENT

Tier One Academy may provide or arrange emergency medical care when necessary. The participant accepts full financial responsibility for any medical treatment received.

5. HEALTH & FITNESS DECLARATION

The participant affirms that they are physically and mentally capable of participating safely in martial arts training.
They agree not to participate when injured, ill, or otherwise unfit, and acknowledge responsibility for monitoring their own condition.

6. RULES & CONDUCT

Participants agree to follow all academy rules, safety procedures, and instructor guidance. Tier One Academy may remove any participant for unsafe or inappropriate behavior without refund.

7. PHOTO & VIDEO RELEASE

Tier One Academy may record training sessions or events for instructional, promotional, or marketing purposes. Participants who do not consent must provide written notice to the academy.

8. MINOR PARTICIPANTS

For participants under 18, a parent or legal guardian must agree to the full terms of this waiver. All provisions apply equally to minor participants.

9. SEVERABILITY

If any portion of this agreement is found unenforceable, the remainder shall remain valid and in full effect.

10. ACKNOWLEDGMENT

By participating in Tier One Academy activities, the participant acknowledges that they have read, understood, and voluntarily accepted the terms of this waiver, and understand they are releasing substantial legal rights.

TIER ONE ACADEMY

GYM MEMBERSHIP AGREEMENT

This Gym Membership Agreement (“Agreement”) is entered into between Tier One Academy (“Academy”) and the individual purchasing membership (“Member”). By accessing or using the Academy’s facilities and services, the Member agrees to the terms below.

1. MEMBERSHIP TERMS

The Member is purchasing a membership that grants access to Tier One Academy’s facilities, equipment, classes, and programs as outlined by Academy policies. Membership type, duration, and pricing are determined at the time of enrollment.

2. PAYMENT & BILLING

• Membership fees are billed according to the membership plan selected.

• Payments are non-refundable unless required by law.

• Monthly memberships renew automatically until canceled by the Member.

• Member authorizes Tier One Academy to charge the payment method on file for recurring dues.

• Late or declined payments may result in service interruption and/or additional fees.

• Tier One Academy may adjust membership pricing with reasonable notice.

3. CANCELLATION POLICY

• Monthly memberships may be canceled with written notice as required by Academy policy.

• Prepaid or term-based memberships may not be canceled or refunded unless otherwise stated in writing.

• Tier One Academy reserves the right to suspend or cancel a membership for rule violations or inappropriate behavior.

4. FREEZE / HOLD POLICY (if applicable)

Members may request a temporary hold on their membership according to Tier One Academy policies. Hold fees may apply.

5. MEMBER RESPONSIBILITIES

The Member agrees to:

• Follow all Tier One Academy rules and staff instructions

• Use equipment respectfully

• Clean equipment after use

• Maintain appropriate behavior toward staff and other members

• Report any equipment issues to staff

Members are responsible for any damages caused by misuse of Academy property.

6. CHANGES TO TERMS

Tier One Academy may update membership policies, rules, or pricing at any time. Members will be notified of any material changes.

7. GOVERNING LAW

This Agreement is governed by the laws of the state of Colorado.
